The following terms and conditions apply to all visitors of the site as well as all website development/design services provided by Camo People to the Client.

It is not necessary for any Client to have signed an acceptance of these terms and conditions for them to apply. If a client accepts a quote, then the Client will be deemed to have accepted the terms and conditions in full. By Purchasing or using the services in any manner, the client represents that he has read, understood and agreed to all terms in this agreement and is at least eighteen (18) years old and has the legal ability to engage in a contract.

Please read the terms and conditions carefully, as any purchase or use of our services implies that you have read and accepted our terms and conditions. If you object to any of the below terms or the site’s Privacy Policy, please do not use the site. The terms are subject to change at any time.

All content available on the Site is the copyrighted work of Camo People.  Any reproduction or redistribution of this Site, in whole or in part, without the written permission of Camo People is expressly prohibited by law, and may result in civil and criminal penalties. All text, graphics, editorial content, data, formatting, graphs, designs, HTML, look and feel, photographs, music, sounds, images, software, videos, designs, typefaces and other content (collectively “Proprietary Material”), as well as the coordination, selection, arrangement and enhancement of such Proprietary Material, that users see or read on the Site is owned by Camo People or is used with permission. Users may not copy, download, use redesign, reconfigure, or retransmit anything from the Site without Camo People’s prior express written permission.

Camo People makes no representations about the suitability of the information or content contained on the Site for any purpose. All such materials are provided “as is” without warranty of any kind. Camo People disclaims all warranties and conditions with regard to the Site, including all warranties and conditions of merchantability, whether express, implied or statutory, fitness for a particular purpose, title and non-infringement. Asa condition of your use of the Site, you will not use the Site for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the Site in any manner that could damage, disable, overburden, or impair the Site or the servers that host it, or interfere with any other party’s use and enjoyment of the Site. You may not attempt to gain unauthorized access to the Site, or accounts, computer systems or networks that may be accessed through the Site, through hacking, password mining or any other means. Camo People may terminate your access to the Site at any time and for any reason with or without notice to you. Camo People shall not be liable to you for any loss associated with termination of such access.

Camo People does not control such websites, and is not responsible for their content. Users further acknowledge that use of any website controlled, owned or operated by third parties is governed by the terms and conditions of use for those websites, and not by Camo People Terms of Use and Privacy Policy. All users do hereby agree to hold Camo People harmless from any liability that may result from the use of links that may appear on the Site.

adherence to proposal

Should services or resources fall above the scope of the original proposal, Camo People reserves the right to either refuse add-ons or invoice appropriately to account for additional time needed. Payment for add-ons that fall above the scope of the original contract is due prior net 15 days.

payment

Invoices will be provided by Camo People upon completion but before publishing the live website. Invoices are normally sent via email; Invoices are due upon receipt. Accounts that remain unpaid thirty (30) days after the date of the invoice will be assessed a service charge in the amount of the higher of twenty percent (20%) per month of the total amount due, whichever is greater.

contract/service termination

If for some reason one part of contract becomes invalid or unenforceable, the remaining parts of it remain in place.

Termination of services by the Client must be requested in a written notice or email and will be effective on receipt of such notice. The Client will be invoiced for design work completed to the date of first notice of cancellation for payment in full within thirty (30) days.

Either party may terminate Camo People contract under the following circumstances:

  • Immediately if the other party becomes insolvent, or appoints a receiver or manager of their assets
  • Immediately if ownership or effective control of the other party is transferred, where such transfer adversely affects the other party’s ability to perform its obligations under this agreement
  • Immediately if either party commits a material breach of the obligations under this agreement and fails to remedy that breach within 21 working days of being notified of that breach
  • Immediately if we find the client in breach of any laws or legal violations mentioned above
  • In any of the other specific circumstances as noted in terms & conditions

In the event of early contract termination by the client, all work done by Camo People up to the point of termination is immediately payable.

refusal of service

Camo People reserves the right to refuse service to any individual, website, or blogs that contain offensive, obscene, hateful, malicious content or any other reason.

liability

Camo People hereby excludes itself and its Employees from all and any liability from any of the following:

Loss or damage caused by any inaccuracy; Loss or damage caused by omission; Loss or damage caused by delay or error, whether the result of negligence or other cause in the production of the web site.

The entire liability of Camo People to the Client in respect of any claim whatsoever or breach of this Agreement, whether or not arising out of negligence, shall be limited to the charges paid for the Services under this Agreement in respect of which the breach has arisen.
